counterfeit trade mark goods "counterfeit trade mark goods" means any goods, including packaging, bearing without authorisation a trade mark which is identical with or so nearly resembles the trade mark validly registered in respect of such goods, or which cannot be distinguished in its essential aspects from such a trade mark, and which infringes the rights of the proprietor of the trade mark under this Act; ACT 175 - TRADE MARKS ACT 1976 70C.
